‘Dismiss Mkhwebane’s speculative, bad-faith rescission application’

DA tells ConCourt her litigation is ‘utterly hopeless ... brought in bad faith for ulterior purposes’

Suspended public protector Busisiwe Mkhwebane’s latest rescission application to the Constitutional Court was “based purely on speculation and conjecture”, said an affidavit on behalf of the speaker of parliament to the apex court.

The DA’s affidavit was less diplomatic: “It is utterly hopeless litigation, brought in bad faith for ulterior purposes and which has the effect of undermining and discrediting this court and the judiciary as a whole.”

The speaker and the DA were responding Mkhwebane’s unprecedented application to the Constitutional Court in May to rescind an order in which it rejected an earlier application by her to rescind a judgment it handed down in February. That ruling cleared the way for an impeachment process in parliament. Both have said the application should be dismissed...
