Bigots and racists beware: hate speech laws are going nowhere

ConCourt is still to have its final say on the legislation – and it’s likely to decide that much of it must stay

While the Supreme Court of Appeal has moved to amend “overbroad” and “vague” hate speech legislation which overran the constitution, it is not open season for racists, homophobes and bigots.

Controversial former diplomat and “gay is not okay” columnist Jon Qwelane successfully challenged the constitutionality of the Promotion of Equality and Prevention of Discrimination Act (PEPUDA), with the SCA declaring last week that hate speech provisions were invalid.

The ruling will need to be confirmed by the Constitutional Court before being pushed back to parliament to be re-tailored...
