Sexual assault, says woman. Man denies it. Court reaches surprise verdict

A Sol Plaatjie University student who was accused of the unsolicited “cuddling and dry-humping” of another student has managed to overturn his sexual assault conviction and suspended prison sentence.

On November 8, the Northern Cape High Court granted the young man’s appeal after he was initially sentenced to four years’ imprisonment, though it was wholly suspended for five years if he did not commit any other crimes in that period.

According to the judgment by acting deputy judge president Cecile Williams from November 8, both the complainant and accused had agreed to a series of common cause facts about the night of the incident...
