Judge overturns engineer’s ‘unreasonable’ win against city

The ex-civil engineer was found to have defrauded the City of Tshwane out of R168,000

A former civil engineer at the City of Tshwane who admitted to defrauding the local government out of R168,000 still had the audacity to claim wrongful dismissal – and succeeded in getting the SA Local Government Bargaining Council (SALGBC) on his side.

But now the Labour Court has questioned the council’s conduct, saying not only was it clear Kgomotso Banda had basically confessed to the crime, but the arbitrator at the CCMA had also wilfully ignored that, showing bias.

In a ruling from August at the Johannesburg Labour Court, Judge Robert Lagrange provided the background to how Banda was accused of defrauding the government. Banda had allegedly been using the city’s financial systems (known as SAP) to perform illegal transactions...
